In the name of God amen I John Rutherford of
the county & state aforesaid being in a low state of health and it
is appointed once for all men to die and being of sound mind and memory
and being desirous of making a distribution of what property is has pleased
God to bless me with I make this my last will and testatment revoking all
others.
I give and bequeath to my beloved wife Rebeckah
Rutherford one hundred & eighty acres of land being part of lot No.
173 one hundred and seventy three acres in 23 District Wilkinson, said
lot of land on the Northwest side and one hundred one and 1/4 acres
where on I now live, together with all my household and kitchen furniture,
all my stock of horses, cattle and hogs during her natural life; after
her death I give to my sons-in-law William Merritt five dollars, the ballance
of my property to be sold and equally divided between the balance of my
children - namely - James Rutherford, Daniel Fann my son-in-law, Samuel
Rutherford, John Rutherford, Franklin Rutherford, Nathan Rutherford, Elbert
Rutherford. I hereby nominate and appoint my son Nathan Rutherford my Executor
to this my last Will and Testament.
Signed sealed and acknowlege before Samuel Bell, James Pearce, Marian Pearce subscribing witnesses this 30th day of December 1851.

of John Rutherford having been duly sworn at this regular term in open
court upon the oath of samuel Beall, James Pearce subscibing witnesses
who saw Marian Pearce her name as a witness to said Will ordered that the
same be admitted to record
